Miller v. LaSalle Bank (7th Cir.)

Amendment to Indiana recording statute applied to all mortgages, whenever filed. IC 32-21-4- 2(c) amends the Indiana recording act so that mortgages with certain technical defects are still considered to provide constructive notice. The 7th Circuit Court of Appeals held that the amended statute applied to all mortgages regardless of when they had filed. The statute's use of the phrase "is recorded" was ambiguous, the Court of Appeals found. Applying the statute retroactively would not upset vested substantive rights, as debtors did not have vested rights to the effect of technical defects at the time their mortgage was recorded. Importantly, the same legislative session enacted, within ten months, a subsequent amendment clarifying the subject amendment which stated that the subsection "applies regardless of when a mortgage was recorded."

Profits Up ... Employment to Follow (next Year)

Since 1980, employment has fallen after corporate profits have risen and vice versa. But there's about a one-year lag between the two trends. Gives a whole new meaning to the term lagging indicator.

New Home Sales Hit Record Low

WASHINGTON — According to the Commerce Department's report released Wednesday, sales of new homes plunged to a record low in January; underscoring formidable challenges facing the housing industry as it recovers from the worst slump in decades. New-home sales dropped 11.2% to a seasonally adjusted annual pace of 309,000 units, the lowest level on record. In fact it fell to the lowest in nearly a half century. And the drop was a surprise to economists who were expecting a slight increase over December's pace. While winter storms were partly to blame, sales have fallen for 3 consecutive months despite sweeping and often heavy-handed government support.

Summary The U.S. Trustee brought a Motion to Dismiss pursuant to 11 U.S.C. § 707(b)(3). Debtors objected and asked that they be allowed to keep their investment property. The Court noted that being able to keep said property would defeat the purpose of the Code, which makes debtors pay what they can to creditors. Accordingly, Debtors will be given six weeks to divest themselves of their investment property, convert to Chapter 13, and file a plan. Otherwise, the Motion to Dismiss will be allowed and their case dismissed.

Bureau of Labor Statistics comes this employment synopsis for January 2010.
 
It turns out the unemployment rate fell from 10% to 9.7% in January and non-farm payrolls were unchanged.
 
Employment fell in construction, transportation, and warehousing.
 
Temporary help services and retail trades added jobs however.

Muzak Emerges from Chapter 11

On Monday Muzak Holdings LLC announced that it has completed its financial restructuring and has emerged from bankruptcy protection.The company, which provides background music programming is heard in stores, office buildings and on-hold phone systems, filed for Chapter 11 bankruptcy protection in Delaware a year ago to refinance heavy debt. The Fort Mill, S.C., company said it has significantly improved its balance sheet, reducing its outstanding debt by more than half and realigning its organizational structure to improve its clients' experience. In a prepared statement Stephen Villa, CEO of Muzak, was hopeful for the post-reorganization future of the company, saying:

As we move into the future, our strengthened capital structure provides us with the renewed ability to invest in new talent and technology that will allow us to provide new offerings and further enhance the first class products and services that our clients have come to expect from Muzak

Banks Choking the Life out of Small Businesses?

According to a recent survey by the Fed, not one senior loan officer will be loosening lending standards for small businesses (the "backbone of the economy" according to the Whitehouse). In fact, some are still tightening them.

By contrast, not a single loan officer reported tightening standards for big businesses, and a small percentage will actually be loosening standards. Exactly the reverse. Read the Full Story on Business Insider-a

iPhone OS 3.2 - Video Calls, Downloads, Multitasking

The folks at Engadget say they've confirmed that the next iPhone upgrade (operating system 3.2) will support video calling and file downloading. That amounts to a kind of limited multitasking capability too. Not as exciting as it could be, but it's still an interesting indication of things to come. You can read the original post here.
